The arbitration, as one of the most efficient way of dispute settlement, attains it’s finality with the making of an award by the arbitrator.
However, sometimes the story does not simply finish here, because there are provisions under the Indian Arbitration Act 1996, which permits a party, with limited grievances against the award, to challenge it before the courts of law.
Equally, in the due course of time, these grounds have duly been tested by the Indian courts while considering unique facts and issues of each and every dispute.
It would be interesting to examine and understand, how these provisions aiming towards challenging an award has shaped the Indian arbitration regime lately.
