1. Terms & Conditions

Indo Spanish Chamber of Commerce registered offices at HT House Building Kasturba Gandhi Marg, New Delhi (hereinafter, individually, or collectively " Indo Spanish Chamber of Commerce "). You can contact the company through the email secretarygeneral@indospanishcc.org.

2. Conditions

2.1 Definitions

• “User or You” shall mean any person who is browsing the Platform and/or uses the Platform in any manner.
• “Members” shall mean any person with active user account the Platform
• “Platform” or “Website” shall mean the website made available at https://indospanishcc.org
• “Product” shall mean type of product that Members can elect to pay for on the Platform.
• “Order” shall be defined as the process detailed in Clause 2.6.1 and 2.6.2 below.

2.2 Acceptance

This Legal Notice regulates access to the website https://indospanishcc.org/ (hereinafter, the “Website”) and the use of the contents and services made available to Users who access the Website (hereinafter, the "Users"). The use of the Website by Users implies the full and unreserved acceptance of all the conditions included in the Legal Notice that is in effect in each access to the Website. Since Indo Spanish Chamber of Commerce reserves the right to modify, at any time and without prior notice, this Legal Notice, the user must read it carefully on each of the occasions in which he/she intends to use any of the contents and services offered in the Website, since it may have undergone modifications. Some services of the Website may be subject to particular conditions that substitute, complement or modify this Legal Notice and must also be accepted by the Users before the provision of the service in question begins. Indo Spanish Chamber of Commerce may freely suspend, block, interrupt or cancel the Service in the following cases:

• to guarantee the security of the service or the access channel,
• when the Website is used fraudulently or abusively,
• when necessary to carry out maintenance or repair of the service, and
• when there is a breach by the User.

Access to the Website is free except for the cost of the connection through the telecommunications network provided by the access provider that the Users have contracted. Access to the Website, and especially, the contracting of the products and services offered through it, are reserved for people over 18 years of age, not making Indo Spanish Chamber of Commerce responsible for the consequences arising from the breach of this measure.

2.3 Use

Users undertake to use the contents of the Website in accordance with the provisions of the Law and this Legal Notice, responding to Indo Spanish Chamber of Commerce or third parties, the damages that may be caused as a consequence the breach of said obligations, and the actions carried out that are illegal, negligent, fraudulent, or that contravene the principle of good faith, generally accepted uses or public order. It corresponds to Indo Spanish Chamber of Commerce the exclusive exercise of the rights of exploitation of the mentioned intellectual and industrial property, in any form and, especially, the rights of reproduction, distribution, public communication and transformation. In an enunciative but non-limiting manner, and in accordance with applicable law, Users are prohibited from performing the following actions:

• Reproduce, copy, distribute, make available, publicly communicate, transform or modify the contents except in cases authorized by law or expressly consented to by Indo Spanish Chamber of Commerce.
• Extract and / or reuse all or a substantial part of the contents of the Website that Indo Spanish Chamber of Commerce makes available to Users.
• Duplicate, copy, sell, resell or exploit Indo Spanish Chamber of Commerce Services for commercial purposes, without our prior consent.
• Use any trademark, logo or other information protected by copyright of Indo Spanish Chamber of Commerce without the corresponding prior authorization.

The use or misuse of these brands or other materials, except as permitted herein, is expressly prohibited and may violate Intellectual Property, Trademark laws, confidentiality and publicity laws, and communications laws and regulations. It must also be taken into account that Indo Spanish Chamber of Commerce requires the active and vigorous fulfilment of all its intellectual and industrial property rights to the maximum legal extent.

2.5 Responsibility

• Of the information and contents

Indo Spanish Chamber of Commerce ensures that the contents collected on its website are of the highest possible quality, but does not guarantee their accuracy, completeness and topicality. Access to the Website and the use that may be made of the information and contents that appear is the sole responsibility of the Users. Indo Spanish Chamber of Commerce will not be liable for the consequences or damages that could be derived from said access or use of the information or the contents.

Any attempt or activity in violation or contrary to the laws in force, related or not to the data protection regulations and / or to the prohibitions stipulated in this document, will make the person responsible for the relevant legal actions, and the sanctions provided for in the law as in this instrument, as well as making the User responsible for compensating the damages caused. The personal information that the User provides will be processed and stored in servers or magnetic media that maintain high standards of security and protection, both physical and technological, with procedural, technical and physical security devices to prevent against loss, misuse or unauthorized access, disclosure, alteration or destruction of the personal information provided in them. Indo Spanish Chamber of Commerce cannot guarantee that all data transmission is completely secure. It is possible that third parties that are not under the control of Indo Spanish Chamber of Commerce may intercept or access private transmissions or communications illegally. Therefore, any transmission of personal information is done at the risk of the User.
• Of the quality and availability of access
Indo Spanish Chamber of Commerce does not guarantee the absence of viruses, worms, Trojans, keyloggers, botnets, spyware, adware, ransomware or any other harmful computer element. Users will be responsible for using the appropriate and updated tools, means or systems for the detection and disinfection of harmful computer elements. Indo Spanish Chamber of Commerce is not responsible for damages caused to the computer equipment of the Users or third parties during or as a result of access to the Website. Access to the Website requires services and supplies provided by third parties, without it being the responsibility of Indo Spanish Chamber of Commerce to control their quality, availability, continuity and operation. Indo Spanish Chamber of Commerce is not responsible for any damages or losses of any kind caused to Users that are the result of failures, interruptions or suspensions of the connection service to telecommunications networks during access to the Website. Indo Spanish Chamber of Commerce does not guarantee the lack of availability, maintenance, and effective operation of the Website and / or its services. However, you will use your best efforts to ensure that the Website is always accessible and fully operational.

The Website may include linking devices that allow Users to access other Internet pages and portals (hereinafter, the "Linked Sites"). In these cases, Indo Spanish Chamber of Commerce  acts as an intermediary service provider and will only be responsible for the content provided on the Linked Sites to the extent that it has effective and manifest knowledge of its illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, he/she may notify Indo Spanish Chamber of Commerce so that he/she may carry out an investigation on the legality of the contents if he considers it pertinent. However, said communication does not bind Indo Spanish Chamber of Commerce to withdraw the corresponding link. Users are also informed that the existence of links on the Website does not imply the existence of agreements with those responsible or owners of such Linked Sites, nor the recommendation, promotion, or identification of Indo Spanish Chamber of Commerce with the statements, contents or services that the portals of the Linked Sites offer. Indo Spanish Chamber of Commerce does not know the contents and services of the Linked Sites, so it is not responsible for the damages caused by the illegality, quality, outdated, unavailability, error and uselessness of the contents or services of the Linked Sites. It should be noted that the Linked Sites will be governed by their own privacy policies and terms of use. 2.6 Members

The website has a restricted content section for only the members of Indo Spanish Chambers of Commerce with registered and active accounts on the website. The Indo Spanish Chambers of Commerce holds the right to refuse and approve registration, activation and/or termination of all the member accounts on the website. All members accounts’ access to the restriction content section is only for limited time duration set on individual basis as deemed by the Indo Spanish Chambers of Commerce.

2.6.1 New Membership Process

The Order for becoming registered member on the website shall be deemed to have been successfully placed on completion of the following process:

• The User submits Application Form online
• The Indo Spanish Chambers of Commerce validates, approves and intimate’s user to make payment on the website via payment link.
• The User selects the preferred payment method from the available payment options.
• The payment for the required amount is processed and has been irrevocably credited in the intended account;
• Upon the successful payment, Indo Spanish Chambers of Commerce activates user account(s) on the website
• A receipt of confirmation of Payment is received by the User by way of e-mail on the registered email ID.

2.6.2 Membership Renewal / Services Payments

The Order for existing members in making successful payment on the website shall be deemed to have been successfully on completion of the following process:

• The User logs in onto the website by visiting Member Section  Online Payment area and chooses to a type of service for which he/she intends to make payment for
• The User selects the preferred payment method from the available payment options;
• The payment for the required amount is processed and has been irrevocably credited in the intended account;
• A receipt of confirmation of Payment is received by the User by way of e-mail on the registered email ID.

2.6.3 Pricing

• All prices indicated on the Platform are in INR and inclusive of all taxes.

2.6.4 Member Conduct and Rules.

• The User shall not upload, publish, update or share any information that, in the sole discretion of Indo Spanish Chambers of Commerce is in any way grossly racial, harmful, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, racially objectionable, disparaging or otherwise unlawful in any manner; interferes with or disrupts access to the Platform or servers or networks; falsifies or deletes any author attributions, legal or other notices or proprietary designations or labels of the origin or source of software or other material on the Platform; and/or involves an illegal or unauthorised use of copyrights work.
• The User shall not promote or try to gain unauthorised access or exceed the scope of authorised access to the Platform and its connected network.
• The User shall not interfere with another User’s use of the Platform.
• The User shall not attempt or otherwise impersonate another person during the use of the Platform.
• The User shall not use the Platform for any purpose that is unlawful or otherwise prohibited by these terms.
• User shall receive a password and account designation upon completing the registration process on the Platform.
• The User shall be solely responsible for the maintenance and security of Your User ID and password. You also agree that You will be solely responsible for any activities, authorised or unauthorised, including Orders placed, payments made and/or breach of any terms of this Agreement conducted on or through Your account whether or not You are the individual who undertakes such activities.
• The User’s ID and password are unique to You, and You agree not to disclose or share Your User ID and password to or with any third party.
• The User shall release and hold harmless Indo Spanish Chambers of Commerce from any and all claims and cause of action arising out of or resulting from a third party’s unauthorised use of Your Account.

If the User is dissatisfied with the Platform or Products being made available by Indo Spanish Chambers of Commerce, User’s sole remedy is to discontinue using the Platform and/ or Products.

2.7 Payment Mechanism

• Purchase of Products by placing an Order with Indo Spanish Chambers of Commerce shall be completed by payment methods provided on the Platform. Payments can be made via Credit Card/Debit Card/Net Banking/UPI/Wallets.
• The User shall ensure his compliance with the terms and conditions of any third-party service provider facilitating payments for placing Orders on the Platform. Indo Spanish Chambers of Commerce shall not be liable for any issues regarding payments/refunds and the same shall be addressed with the relevant service provider in accordance with their terms and conditions.
• Indo Spanish Chambers of Commerce reserves the right to change the accepted methods of payment at its sole discretion.
• Indo Spanish Chambers of Commerce does not warrant that all methods of payment are available at all times

2.8 Refund Policy

Once an order is confirmed, Indo Spanish Chambers of Commerce will not accept return or refund requests

3. Force Majeure

Notwithstanding the foregoing, Indo Spanish Chamber of Commerce will not be responsible for delays or failures that may occur in the access, operation of the Website, its Contents and / or Services, as well as any interruptions, suspensions or malfunctions when they had their origin in breakdowns caused by natural disasters such as earthquakes, floods, lightning or fires, situations of force majeure, situations of extreme urgency such as wars, military operations, civil disturbances, strikes, lockouts or any other force majeure situation or fortuitous case.

4. Compensation

Users expressly agree to indemnify Indo Spanish Chamber of Commerce, its group companies, employees, administrators, agents, and others affected, for the damages and losses (including attorneys' fees, attorney's rights and costs) arising from breach by Users of these general conditions and of the particular conditions applicable in their case, as well as to collaborate with Indo Spanish Chamber of Commerce in the defense of their interests in the event that any claim is filed or any judicial or administrative proceeding is initiated for said breach. Likewise, Users are obliged to make their best efforts in order to avoid or, where appropriate, reduce the harmful and harmful effects that may be derived from it for Indo Spanish Chamber of Commerce. Indo Spanish Chamber of Commerce will not be responsible for (i) indirect and consequential damages or (ii) business losses (including lost profits, income, contracts, expected savings, data, loss of goodwill or unnecessary expenses incurred) that they are a direct or indirect result of the access to the Website by the Users.

5. Security Warning

The "phishing" and other fraudulent actions of theft and impersonation of a person, consist of third parties simulating the identity of an entity through the fraudulent use of email to get their personal data through deception. 10. Jurisdiction

The Legal Notice of this Website will be governed by the legislations in India. Indo Spanish Chamber of Commerce and the Users expressly renounce their own jurisdiction that may correspond to them, and formally submit to the Courts and Tribunals of India for any dispute that may arise due to the interpretation or compliance with the Notice Legal by which this Website is governed.
