Webinar on 'New Labour Law Regime - What to Expect & Key Changes

In the webinar speakers Anshul Prakash (Partner, Employment Labour and Benefits Practice) and Abhinav Rastogi (Principal Associate, Employment Labour and Benefits Practice) from Khaitan & Co would endeavour to navigate through the codes, discuss the changes introduced and likely the overall impact on the employers, and also share some myth-busting insights into the codes.

 

History: The years 2019 and 2020 saw the President of India assenting to the four labour codes viz. Code on Wages 2019, Code on Social Security 2020, Industrial Relations Code 2020 and Occupational Safety, Health and Working Conditions Code 2020, intended to consolidate labour law regime in India. While these codes await notifications from the Government of India to be made effective as law (barring provisions relating to Central Advisory Board on minimum wages), a need is felt across industries to be prepared for certain operational and financial impact arising therefrom as regards their workforce.

 

Key Learning from the webinar: While several compliances including procedural aspects have been left to the appropriate government to set out by way of rules, there are some provisions in the codes which are already catching everyone’s attention. These include express recognition of fixed term employment (albeit with conditions), prohibition on engagement of outsourced workforce in core operations, implications of the revised definition of ‘wages’, extension of restrictions relating to strikes and lockouts to all establishments, and wider application of provisions relating to inter-state migrant workers as well as aspects of overtime, working conditions, health and safety.
